RIGHTS AND DUTIES OF THE ENTREPRENEUR


Art. 38 of the Spanish Constitution that enshrines freedom of enterprise, the employer we recognize a series of rights or powers, as well as a series of duties.

Rights of the entrepreneur:



  • The power of direction. Faculty to issue orders on the mode, time and place of execution of the work, as well as on the quantity and quality thereof.



  • The power of variation. It is the faculty that the employer has to modalize, vary, transform the execution of the work in order to adapt the labor provision to the changes in the professional qualification of the worker


  • The disciplinary power. It consists of the power to monitor and control the execution of work and compliance by the worker of their obligations, as well as the power to impose the appropriate penalty in case of not fulfilling their duties



Duties of the entrepreneur:



  • Professional duties: equal treatment, professional promotion and respect for the professional category of the worker
  • Moral or ethical duties: respect for the privacy and dignity of the worker
  • Physical duties: adequate occupational safety and health policy
  • Economic duties: duty to pay the salary and the worker's Social Security contribution.
